The organisation has responded to recent figures from the Financial Ombudsman Service (FOS), showing complaints against credit card companies over payment insurance have risen by 50 per cent in the last 12 months.
Senior researcher for Which? Martyn Saville commented: "You've got a choice between going to a retailer and going to a credit card company. Section 75 is really clear; it's black and white.
"If you choose to go to the credit card company they shouldn't be rejecting it [ ] it is your right to go after the credit card company for a refund."
Mr Saville added that consumers who felt pressured into applying directly to the retailer for a refund by their credit card company should put their complaint in writing and state clearly that they are making a claim under Section 75.
